Holiday accrual during dormant employment? Dutch courts have taken different approaches to this question in recent years, creating uncertainty for employers dealing with long-term incapacity cases and so-called “dormant” employment relationships. The District Court of Rotterdam has now referred preliminary questions to the Dutch Supreme Court in an effort to obtain clarity on whether employees continue to accrue vacation entitlements during such periods. Given the time involved in UWV dismissal procedures and statutory notice periods, the answer may have significant financial consequences in practice.
