New episode of Littler Explains!: Dismissal After a TUPE Transfer, Explained! When a business transfers, employees often tag along. But does that also mean dismissal is not at all an option? In this episode, our host Jasper Hoffstedde speaks with Wouter Engelsman and Isa Hooijmaijers about a recent Dutch Supreme Court judgment that clarifies how employers should approach dismissal after a TUPE transfer, and in particular the role of ETO reasons (economic, technical or organisational grounds). The Court introduces an important nuance that will be highly relevant in practice, especially for employers navigating reorganisations following a transfer. What does this mean in concrete terms, and where exactly is the line drawn? We explore the legal framework, the case itself, and the practical implications for employers in the Netherlands. I love a podcast. Slightly addicted, if I’m honest. Lately, I’ve been deep into The Rest Is Entertainment; partly for what it says, but also for how it sharpens the way I think. Two concepts stuck with me: - MacGuffins — things that appear important but don’t actually drive the story (think the suitcase in Pulp Fiction) - Chekhov’s Gun — if something is introduced, it must matter later That second one? That’s the one. Because here’s the reality… With the rollout of the Employment Relations Act, businesses can’t afford to treat HR like a collection of MacGuffins; policies, processes, and updates that exist… but don’t really do anything. That’s where things start to drift. Inconsistency creeps in. Risk builds quietly in the background. Instead, this needs to be treated like a Chekhov’s Gun. If it’s introduced: 👉 it needs to be understood 👉 it needs to be implemented 👉 and it needs to have impact Think the noticeboard in The Usual Suspects. Everything was there the whole time; it just wasn’t joined up. And we all know how that ended for Special Agent Kujan…. So, in an effort to make this practical (not theoretical), I’m building a series of one-page guides to help businesses actually implement what’s changing. First up: Statutory Sick Pay which I launched earlier today. Because getting this wrong early? That’s how small issues turn into expensive ones. If you want to sense-check what this means for your business — or you just need an extra pair of HR hands — give me a shout.

Can an employer own an employee's likeness? Have a listen and drop me a note with your thoughts. In the podcast, I also speak about why I enjoy employment law - it sits at the intersection between humanity and commerce, among other things.
