68% of organizations can't track the complexity and volume of their employee relations cases. EEOC discrimination charges rose 9% last year, with 88,531 filed in FY2024. Employers paid $528 million through pre-litigation settlements in 2025, the highest in EEOC history. Financial risk has audits. Cyber risk has heat maps. Employee risk gets narrative updates. That gap has a price: litigation exposure, reputational damage and personal liability for the executives who didn't know. Courts no longer accept that as a defense. Workplace misconduct surged 14 points in 2025. Reporting hit a record high. And 1 in 4 affected employees still said nothing. Our latest research, drawn from 2,043 U.S. employees, finds that the speak-up gap breaks along predictable lines: where people work, how they're classified, whether they know anonymous reporting exists and whether they trust the process won't put a target on their back.
