A major Second Circuit decision is reshaping how multistate wage and hour claims can be brought under the FLSA—potentially limiting plaintiffs’ ability to pursue nationwide collective actions in a single forum. Under the ruling, courts must establish personal jurisdiction over defendants for each opt-in plaintiff before certifying a collective, giving employers a powerful new early-stage defense and increasing the likelihood of fragmented, state-by-state litigation. From insightful panels to global collaboration, the American Bar Association International Law Section Annual Conference in Washington, DC did not disappoint. Fox was proud to return as a sponsor of the conference for another year, with strong participation from members of our International Practice Group throughout the program, including Mark E., Charles DeMonaco, Niloofar Zarei Henzaki and Paul Edelberg. Niloofar and Paul served as program chairs, helping shape important conversations across the conference, including a session on Impact Investing and ESG. Paul also shared his insights as a speaker on a panel exploring joint venture toolkits for cross-border deals. We were especially pleased to bring together attorneys and counsel from across the globe during our hosted dinner, highlighting the collaborative, international nature of the practice.
