Sixteen years after the Deepwater Horizon spill, BP’s Kaskida project could bring another environmental disaster to the Gulf if a loss-of-control event occurred. We’re fighting back in court.

  • WE’RE SUING: The Trump administration moved to allow oil and gas companies in the Gulf of Mexico to ignore endangered species protections. The admin claims this will bring energy security, but Gulf communities know what unrestrained drilling will really bring: devastating oil spills and the destruction of ecosystems and coastal economies. This is the first time an exemption has been granted for an entire industry and has the potential to affect at least 20 endangered and threatened species. "This 'go-ahead' to offshore drillers to extract oil and gas in extremely sensitive ocean areas while killing whales, turtles, and many other species is unnecessary and shameful. We are asking the court to stop this illegal order," said Earthjustice Managing Attorney Steve Mashuda.

    If the US Environmental Protection Agency abandons its authority to regulate greenhouse gases, could it unintentionally reopen the door to climate tort litigation? In an op-ed for Forward Law Review, Sambhav (Sam) Sankar, senior vice president for programmes at Earthjustice, argues that repealing the EPA’s endangerment finding could remove the legal foundation that has long displaced federal common-law climate lawsuits. He explores how the Supreme Court’s decisions in Massachusetts v EPA and American Electric Power v Connecticut shaped the current legal landscape – and why dismantling federal greenhouse gas regulation could revive nuisance and other tort claims against energy companies. With the US Supreme Court now set to hear Suncor v Boulder County, the interaction between federal regulation and state climate litigation is likely to become one of the most consequential legal questions in climate law.     Earthjustice is suing Trump’s EPA for repealing the endangerment finding and trying to abandon its responsibility to protect us from climate change. The endangerment finding requires the EPA to protect us from dangerous greenhouse gas pollution. The Supreme Court confirmed the EPA's authority to regulate greenhouse gases nearly two decades ago and it has been repeatedly affirmed by courts since. “With this action, EPA flips its mission on its head. It abandons its core mandate to protect human health and the environment to boost polluting industries and attempts to rewrite the law in order to do so,” said Earthjustice senior attorney Hana Vizcarra.

  • The Environmental Protection Agency (EPA) has finalized its repeal of the endangerment finding and the rollback of climate emissions standards for light, medium and heavy-duty vehicles. By doing so, the EPA is rejecting settled law and science to benefit polluters. This repeal has no basis in the law or reality. Climate change is fueling extreme weather disasters. The Supreme Court confirmed EPA’s authority to regulate greenhouse gases nearly 20 years ago and courts have reaffirmed it ever since. “The Trump admin is sacrificing our health, our safety, our economy, and our future by abandoning its core responsibility to keep us safe from extreme weather and accelerating climate change.
