Today, the United States Supreme Court ordered that mifepristone remain available through telehealth and by mail while the court case continues in Louisiana. This order protects the health of patients and allows ob-gyns to continue offering patient-centered reproductive health care. The evidence remains clear: Mifepristone is not only safe, but it’s also an essential tool in patient care. ACOG will continue our efforts to protect patients’ access to evidence-based reproductive health care, which includes mifepristone.

Mifepristone remains safe, effective, and legal, and access to it is a cornerstone of reproductive justice. Reproductive justice is more than the legal right to choose; it’s about having the actual resources and support to receive care, regardless of zip code or income. These legal challenges don't happen in a vacuum. They disproportionately harm those already navigating systemic barriers: 👉🏾 Rural communities with limited local providers. 👉🏾 Individuals with low incomes who cannot afford sudden travel costs. 👉🏾 Working parents who cannot take days off to navigate restricted access. Restricting medication abortion isn’t just a policy debate. It is a direct hit to timely, evidence-based healthcare. ACOG Chief Legal Officer Molly Meegan, JD, recently appeared on MSNOW to discuss how the ongoing court case, the State of Louisiana v. U.S. Food and Drug Administration, is affecting ob-gyns and patients across the country as we await a decision from the Supreme Court. “It’s difficult to be an ob-gyn in this country at the moment. It’s even more difficult to be a patient trying to obtain basic, essential reproductive health care,” Meegan said. Telehealth access to mifepristone for medication abortion and miscarriage management is vital for patients living in areas labeled maternity care deserts, defined by March of Dimes as a county without an obstetric care professional or a hospital or birth center offering obstetric care. Without the option of telehealth, these patients would potentially have to travel hours to receive care in addition to finding childcare, taking time off of work, and organizing transportation—challenges that already make these patients less likely to receive care at all. The current attack on telehealth access to mifepristone clearly targets abortion and reproductive health care as a whole; it puts pregnant patients’ health at risk, threatens the patient–physician relationship, and jeopardizes physicians’ ability to provide their patients with evidence-based care.
