The following terms apply to Generative AI Preview Products:
Definitions. “Generative AI Preview Products” means Google Cloud Platform’s generative AI products that are designated as Preview. “Generated Output” means Customer Data that is any data or content generated by a Generative AI Preview Product based on Input Data. “Input Data” means Customer Data that Customer submits to a Generative AI Preview Product.
Additional Use Restrictions. Unless permitted by Google in writing, Customer will ensure that Customer and its End Users will not:
- use a Generative AI Preview Product for commercial or production purposes.
- disclose Generated Output to a third party.
- use Input Data with a Generative AI Preview Product that (i) is personal data of individuals under 18 years of age, or (ii) has been obtained from a website or online service (including mobile apps) directed to children or from children under the age of 13.
- use Generated Output to develop models that compete with the Google Cloud Platform or to reverse engineer or extract a Generative AI Preview Product, its models, or any of its components.
- use a Generative AI Preview Product to make automated decisions that have a material detrimental impact on individual rights without appropriate human supervision.
For the Generative AI Preview Products, the above are also deemed to be “Restrictions” or “Use Restrictions” as described in the Agreement.
Disclaimers. Generative AI Preview Products use experimental technology, may provide inaccurate or offensive Generated Output, and are not designed for or intended to be used to meet Customer’s regulatory or legal obligations. Customer acknowledges that a Generative AI Preview Product may, in some scenarios, produce the same or similar Generated Output for multiple Customers.
Certain Generative AI Preview Products may offer access to components subject to separate open source or third party licenses. Google will make such licenses available to Customer and Customer is responsible for complying with such terms.
For Generative AI App Builder: Generative AI App Builder is a “Discovery Solution” subject to additional terms at https://cloud.google.com/retail/data-use-terms. Customer may use only Input Data and web domains that it owns or is authorized to utilize.
For Health Generative AI Preview Product(s): Customer may not use Health Generative AI Preview Product(s) in clinical practice, to provide medical advice, or in any manner that is overseen by or requires clearance or approval from a medical device regulatory agency.
In addition to these terms, the Pre-GA Offerings Terms at https://cloud.google.com/terms/service-terms apply to the Customer’s use of the Generative AI Preview Products, as well as: (i) the terms of the agreement under which Google has agreed to provide access to the Google Cloud Platform to Customer, (ii) in the case of channel customers, the Google Cloud Platform Terms of Service located at https://cloud.google.com/terms, or (iii) in the case of public sector partners, the terms of the agreement under which Google has authorized that public sector partner to distribute or resell access to the Google Cloud Platform (the “Agreement”).
